The digital age brings with it novel forms of data flow. As a result, individuals are constantly being monitored while consuming products, services and content. These abilities have given rise to a variety of concerns, which are most often framed using “privacy” and “data protection”-related paradigms. An important, oft-noted yet undertheorized concern is that these dynamics might facilitate the manipulation of subjects; a process in which firms strive to motivate and influence individuals to take specific steps and make particular decisions (...) in a manner considered to be socially unacceptable. That it is important and imperative to battle manipulation carries with it a strong intuitive appeal. Intuition, however, does not always indicate the existence of a sound justification or policy option. For that, a deeper analytic and academic discussion is called for. This Article begins by emphasizing the importance of addressing the manipulation-based argument, which derives from several crucial problems and flaws in the legal and policy setting currently striving to meet the challenges of the digital age. Next, the Article examines whether the manipulation-based concerns are sustainable, or are merely a visceral response to changing technologies which cannot be provided with substantial analytical backing. Here the Article details the reasons for striving to block manipulative conduct and, on the other hand, reasons why legal intervention should be, in the best case, limited. The Article concludes with some general implications of this discussion for the broader themes and future directions of privacy law, while trying to ascertain whether the rise of the manipulation-based discourse will lead to information privacy’s expansion or perhaps its demise. We are currently witnessing a sharp rise in the use of algorithmic decision-making tools. In these instances, a new wave of policy concerns is set forth. This article strives to map out these issues, separating the wheat from the chaff. It aims to provide policy makers and scholars with a comprehensive framework for approaching these thorny issues in their various capacities. To achieve this objective, this article focuses its attention on a general analytical framework, which will be applied to a (...) specific subset of the overall discussion. The analytical framework will reduce the discussion to two dimensions, every one of which addressing two central elements. These four factors call for a distinct discussion, which is at times absent in the existing literature. The two dimensions are the specific and novel problems the process assumedly generates and the specific attributes which exacerbate them. While the problems are articulated in a variety of ways, they most likely could be reduced to two broad categories: efficiency and fairness-based concerns. In the context of this discussion, such problems are usually linked to two salient attributes the algorithmic processes feature—its opaque and automated nature. (shrink)

En este artículo se establece un análisis histórico, axiológico y epistemológico de las condiciones de advenimiento de una filosofía médica abocada al estudio de la enfermedad. El examen de estas condiciones toma en cuenta los estudios clásicos y contemporáneos de la filosofía de la medicina, analizando sus distintas perspectivas y enunciados. La reflexión en torno de los supuestos y conceptos asociados a tal tipo de filosofía, localiza la enfermedad en sus distintas dimensiones: en el ámbito del acontecimiento biológico (disease), del (...) orden social (sickness), y de la experiencia vivida (illness). Tres puntos de deliberación presentan el cuerpo nodular de estos análisis: a) la constitución disciplinaria y conceptual de la enfermedad como un hecho total: variantes epistemológicas de la medicina y la filosofía antigua; b) la psicopatología en la constitución de una filosofía de la enfermedad, el análisis epistemológico de dos conceptos: normal-patológico; y c) la filosofía de la vida de G. En este artículo se revisa el lugar que ocupa Eckhart en L’essence de la manifestation, a fin de establecer correspondencias y afini­dades entre el místico renano y la peculiar concepción que de la fenomenología sostiene Michel Henry. Se trata de analizar la es­trecha cercanía entre el alma humana y Dios postulada por Meister Eckhart y su vinculación con la conocida noción de Vida presente en el autor francés. Henry es proclive a fundar una filosofía primera asociada a la pura autoafección, (...) describiendo la Vida sea como pura inmanencia, sea como una ipseidad algo problemática. En general, el trabajo teórico de los representantes del “giro teológico de la fenomenología francesa” (Janicaud) cuestiona al sujeto clásico de la Modernidad, sin por eso traer a colación la causa de un Dios Revelado ni el que resulta de una teología natural. Este trabajo, en suma, no es el esfuerzo de pensar a un Dios confesional ni tiene un propósito evangélico. Lejos de ello, se trata de precisar el nexo entre Henry y Eckhart, puesto en escena por aquél, y si tal nexo es coherente con lo que Henry piensa acerca de un modo de manifestación que ya no implica distancia fenomenológica alguna: la manifestación del pathos de la Vida. En este artículo de investigación se muestra, que durante la fabricación de hierro, las escorias han sido una fuente información del producto obtenido. Esto aplica a toda la historia de la fabricación de este metal desde el inicio de la edad del hierro. Los estudios en este campo se conocen como arqueo de metalurgia y se inicia desde la paleo metalurgia hasta el presente. Las escorias primitivas obtenidas a partir de su separación de la masa de hierro sólida obtenidas en (...) procesos muy primitivos y más modernas como la forja catalana. Estudios petrográficos, de difracción de rayos X y de fluorescencia de rayos x, han revelado la existencia fayalita, en escorias siderometalúrgicas antigüas a temperaturas por debajo del punto eutéctico,deducidas como entre 1150°C y 1200°C. Más recientemente, la presencia de fayalita ha sido revelada en procesos de reducción operando con temperaturas menores a los 900°C. En este documento se presenta una explicación para tal hecho mediante un análisis de las energías asociadas a los sistemas. Cerámicos compuestos de FeO- SiO2-MgO- P2O5 presentes en dichos procesos. As a slew of recent work in epistemology has brought out, there is a range of cases where there's a strong temptation to say that prudential and (especially) moral considerations affect what we ought to believe. There are two distinct models of how this can happen. On the first, “reasons pragmatist” model, the relevant prudential and moral considerations constitute distinctively practical reasons for (or against) belief. On the second, “pragmatic encroachment” model, the relevant prudential and moral considerations affect what one (...) is epistemically justified in believing. The pragmatic encroachment model appears to have several advantages over reasons pragmatism, and this has led many recent philosophers to endorse the former. However, in this paper we argue that a version of reasons pragmatism can be (at least largely) saved from these purported disadvantages once paired with an independently plausible permissivism about epistemically justified outright belief. This hybrid view—“permissivist pragmatism”—holds that when there is more than one epistemically permitted doxastic attitude, practical (including moral) considerations can determine which epistemically permitted doxastic attitude one all-things-considered ought to have. This view avoids both the problems faced by simple versions of reasons pragmatism, and those that distinctively attend pragmatic encroachment, while preserving the advantages of each view. (shrink)

Earnings management behavior is a concern of standard-setters, regulators and the accounting profession. This study examines the ethics of this practice using a national sample of 763 accounting practitioners, faculty and students. Possible determinants of the ethics of this practice such as perceived role of ethics and social responsibility, and personal moral philosophies (i.e. idealism and relativism) are explored. Results indicate a positive relationship between social responsibility, focus on long-term gains, idealism, and the ethical perception of earnings management and negative (...) relationship between focus on short-term gains, relativism and the ethical perception of this practice. Implications for the accounting profession as it deals with the issue of earnings management are discussed. (shrink)

Many traditions have utilized silent environments to induce altered states of consciousness and spiritual experiences. Neurocognitive explorations of spiritual experience can aid in understanding the underlying mechanism, but these are surprisingly rare. We present the verbal report and the electroencephalographic (EEG) alpha profile of a female participant scoring a maximal 34 on the Absorption Scale, recorded before and while she was immersed in a whole-body perceptual deprivation (WBPD) tank. We analyze her trancelike experience in terms of the imagery reported: a (...) spaceship, corridors, doors, a man dressed in white, speaking to God, the sun, supernova, concentric images, and an out-of-body experience. Her report is indicative of a spiritual experience, given that she felt that she was “meeting God” in the laboratory. She exhibited both frontal and parietal left > right alpha power asymmetry at baseline, whereas in the WBPD condition, there was a global increase in alpha power and especially a sharp increase in right-frontal alpha power. Her verbal report and EEG alpha profile were compared to those of another female participant, also scoring high on absorption, whose verbal report was also indicative of a trancelike experience. For further comparison, we present the data for two participants scoring low on absorption. Spiritual experience that can be verbalized might be associated with a marked increase in right-frontal alpha power, as reported here. In contrast, a mystical experience characterized by ineffability would be indicated by a marked increase in left-frontal alpha power. (shrink)

En su último trabajo el historiador Enzo Traverso afirma que las utopías del siglo XX han desaparecido dejando un presente cargado de memoria pero impotente a la hora de proyectarse en el futuro (Traverso, 2018: 34). La era actual del presentismo histórico, tal como lo denomina François Hartog, momifica toda experiencia pasada despojando el potencial revolucionario y, a su vez, anulando la posibilidad de un futuro emancipador ante la inmanencia de lo mismo. Esa fuerza histórica totalitaria se nos presenta como (...) un continuo inanimado carente de toda narración histórica. La historiografía dominante es producto de la adición de relatos inconexos, tanto que el principio de rekonstruktion actualiza el pasado en consonancia a la legitimación de los vencedores. Ante ello, la melancolía de izquierda es un ejercicio que busca “repensar un proyecto revolucionario en una era no revolucionaria” (Traverso, 2018: 55). En la melancolía, a diferencia del duelo, “el sujeto mantiene su fidelidad al objeto perdido, negándose a renunciar a su vínculo con él” (Žižek, 2019: 63). La cultura de la derrota recolectó las huellas del pasado sepultado y es ahora, en un presente uniforme, donde intenta recuperar del olvido aquel proyecto concluido de forma catastrófica. El objetivo del presente trabajo es repensar y construir el pasado a la luz de la recuperación de aquello que no ha acontecido. Recolectar los fragmentos inacabados por intermedio del principio de konstruktion es también dar un haz de luz a la potencia suspensiva del tiempo presente. (shrink)

There is a growing need to increase our understanding of ethical decision making in U.S. based organizations. The authors examine the complexity of creating uniform ethical standards even when the meaning of ethical behavior is being debated. The nature of these controversies are considered, and three important dimensions for ethical decision making are discussed: leaders with integrity and a strong sense of social responsibility, organization cultures that foster dialogue and dissent, and organizations that are willing to reflect on and learn (...) from their actions. Leaders with integrity demonstrate consistency between vision and action that promotes trust, regularly concern themselves with developing moral standards, and are proactive agents of change in an increasingly complex world. Organizational cultures that support dialogue suspend judgments and increase their capacity to think together towards new levels of understanding. Ethical concepts evolve in these organizational cultures, and actions are informed and responsible. Organizations that reflect on their actions engage in double loop learning so that the time taken to reflect on the past and present leads to a more judicious and ethical future. In essence, the authors point to organizational guidelines for ethical decision making that lead to an increase in members' capacity to think and act ethically. (shrink)

BackgroundIn Saudi clinical settings, benevolent family care that reflects strongly held sociocultural values is commonly used to justify overriding respect for patient autonomy. Because the welfare of individuals is commonly regarded as inseparable from the welfare of their family as a whole, these values are widely believed to obligate the family to protect the welfare of its members by, for example, giving the family authority over what healthcare practitioners disclose to patients about their diagnoses and prognoses and preventing them from (...) making informed decisions about their healthcare.DiscussionFamily dominance over the healthcare decisions of competent patients is ethically problematic when the family prevent healthcare practitioners from disclosing diagnoses and prognoses to patients who have the capacity to consent and make decisions in their own best interests. Thus, the author holds that sociocultural values ought to be respected only when they do not prevent competent patients from knowing their diagnoses and prognoses or prevent them from making their own decisions.ConclusionHealthcare practitioners should not allow patients’ families to control what can or cannot be disclosed to competent patients. This is particularly important when patients are approaching death so that they may address their material and spiritual wishes—among other needs—as they prepare for death. Justification for this position is drawn from the Maqasid Al-Shariah-based Islamic bioethics approach, from which it is possible to argue that the harm of withholding diagnoses and prognoses from patients who are imminently dying outweighs the potential benefits. Prescription opioid abuse (POA) is an escalating clinical and public health problem. Physician worries about iatrogenic addiction and whether patients are ‘drug seeking’, ‘abusing’ and ‘diverting’ prescription opioids exist against a backdrop of professional and legal consequences of prescribing that have created a climate of distrust in chronic pain management. One attempt to circumvent these worries is the use of opioid contracts that outline conditions patients must agree to in order to receive opioids. Opioid contracts have received some scholarly attention, (...) with trust and trustworthiness identified as key values and virtues. However, few articles have provided a critical account of trust and trustworthiness in this context, particularly when there exists disagreement about their role in terms of enhancing or detracting from the patient–physician relationship. This paper argues that opioid contracts represent a misleading appeal to patient–physician trust. Assuming the patient is untrustworthy may wrongfully undermine the credibility of the patient's testimony, which may exacerbate certain vulnerabilities of the person in pain. However, misplaced trust in certain patients may render the physician vulnerable to the potential harms of POA. If patients distrust their physician, or feel distrusted by them, this may destabilise the therapeutic relationship and compromise care. A process of epistemic humility may help cultivate mutual patient–physician trust. Epistemic humility is a collaborative effort between physicians and patients that recognises the role of patients’ subjective knowledge in enhancing physicians’ self-understanding of their theoretical and practice frameworks, values and assumptions about the motivations of certain patients who report chronic pain. Public accounting firms can build integrity within their organizations through early detection of fraud. One way to reduce and detect fraud is to encourage whistleblowing as a prosocial behavior. We explore the impact of mentoring on intention to report fraud. A survey with 120 responses from the US public accountants suggests that quality mentoring relationships, a common feature in the profession, and caring ethical climate positively relate to internal reporting of fraud. Two intermediate variables, trust and affective commitment, mediate these (...) effects. Mentor-relationship quality also increases perceptions of caring ethical climate. The study contributes to two bodies of research by finding extended benefits from mentoring, beyond those typically discussed in academic literature; and identifying a previously unexplored firm intervention capable of positively influencing prosocial behavior and combating fraud. In his Encyclopaedia Logic, Hegel affirms that truth is ‘usually’ understood as the agreement of thought with the object, but that in the ‘deeper, i.e. philosophical sense’, truth is the agreement of a content with itself or of an object with its concept. Hegel then provides illustrations of this second sort of truth: a ‘true friend’, a ‘true state’, a ‘true work of art’. Robert Stern has argued that Hegel's ‘deeper’ or ‘philosophical’ truth is close to what Heidegger labelled ‘material’ (...) truth, namely a property attributed to a thing on the basis of the accordance of that thing with its essence. It has since been common to think of Hegel's concept of ‘philosophical’ truth as ‘ontological’, ‘objective’ or ‘material’ in contrast to ‘epistemological’ or ‘propositional’ definitions. In this paper, I wish to add an important nuance to the existing literature on this subject: even though things have a truth-value for Hegel, the latter is always negative. I argue that Hegel's criterion of ‘philosophical’ truth, which is best formulated as ‘agreement with self’, is first and foremost intended to examine the truth-value of thought-determinations. I then argue that even though this criterion may also be applied to examine the truth-value of things (namely, even though things have a truth-value), things never fall under this definition. After reviewing several of Hegel's explicit remarks on the matter, I provide an alternative explanation to those features of Hegel's ‘philosophical’ truth which have led scholars to view it as a truth in things. Especially, I argue that what are generally seen as Hegel's examples (‘true friend’, ‘true state’, ‘true work of art’) are not intended as examples but only as imperfect illustrations of ‘philosophical’ truth. We consider a question of T. Jech and K. Prikry that asks if the existence of a precipitous filter implies the existence of a normal precipitous filter. The aim of this paper is to improve a result of Gitik (Israel J Math, 175:191–219, 2010) and to show that measurable cardinals of a higher order rather than just measurable cardinals are necessary in order to have a model with a precipitous filter but without a normal one.

In 1958, moral philosophers were given rather startling advice. They were told that their subject was not worth pursuing further until they possessed an adequate philosophy of psychology. What is needed, they were told, is an enquiry into what type of characteristic a virtue is, and, furthermore, it was suggested that this question could be resolved in part by exploring the connection between what a man ought to do and what he needs : perhaps man needs certain things in order (...) to flourish, just as a plant needs water; and perhaps what men need are the virtues, courage, honesty, loyalty, etc. Thus, in telling a man that he ought to be honest, we should not be using any special sense of ought: a man ought to be honest just as a plant ought to be watered. In forging this new materialism, Žižek critiques and challenges not only the work of Alain Badiou, Robert Brandom, Joan Copjec, Quentin Meillassoux, and Julia Kristeva (to name but a few), but everything from popular science and quantum mechanics to sexual difference and analytic philosophy. Cemil Şahinöz liefert eine wissenschaftliche und theologische Grundlage für den Begriff der islamischen Seelsorge und entwickelt darüber hinaus ein Konzept über die Arbeit der Seelsorge für die Gruppe der Muslime in Deutschland. Der Autor analysiert mehrere Seelsorgedisziplinen, macht eine breite Bestandsaufnahme, interviewt Seelsorger und Ausbilder islamischer Seelsorger und untersucht islamische Seelsorgekonzepte in anderen Ländern. Die islamische Theologie und die historische Entwicklung der Seelsorge innerhalb der muslimischen Gemeinschaften standen für die Erarbeitung seines Konzepts im Fokus.

This review article discusses the adoption of blockchain in the ports and shipping industry to support digital transformation. It also explores the integration of this technology into the current ports and shipping ecosystem. Besides, the study highlighted the situation of the supply chains management in ports and shipping domain as (...) a case study in this field. This review contributes to research by focusing on the adoption of blockchain in the ports and shipping industry to support digital transformation.
